AGREEMENT ON NATIONAL AND INTERNATIONAL SUPPORT FOR THE ROUNDTABLE FOR DIALOGUE AND NEGOTIATION

The national government and the Revolutionary Armed Forces of Colombia – People’s Army (Fuerzas Armadas Revolucionarias de Colombia – Ejército Popular, FARC–EP), having met on 6–7 February 2002 in Los Pozos in the municipality of San Vicente del Caguán, in the presence of representatives of the Facilitating Commission, the Special Envoy of the Secretary General of the United Nations and the Catholic Church of Colombia, have reached the following agreement.
RECITALS
The national government and FARC–EP signed the Agreement of Caquetania on 2 May 1999, which stated:
“in this respect, by common agreement, we establish an international support commission to act as a verifying body to overcome any obstacles that may arise”.
In implementation of the Agreement of Los Pozos, in Communication No.
27, dated 9 March 2001, the parties agreed to “the National Roundtable for Dialogue and Negotiation has decided to create a Facilitation Commission of ten countries, which will meet every two months to receive information about the progress of the process and guide, coordinate and facilitate, among other aspects, a twice-yearly meeting with all the friendly countries to hear their opinions in the context of moral, political, economic and technical support and incentivise their cooperation through various activities”.
The following are members of the International Facilitation Commission:
Canada, Cuba, France, Italy, Mexico, Norway, Spain, Sweden, Switzerland and Venezuela.
The national government and FARC–EP signed the Agreement on the Consensus Timeline for the Future of the Peace Process on 20 January 2002, which stated that:
“the parties will form an international support commission by mutual agreement to act as a verifying body for the agreements and to overcome any obstacles that may arise, as set out in the Agreement of Caquetania”.
In the Agreement on the Consensus Timeline for the Future of the Peace Process the national government and FARC–EP expressed their gratitude for the role played by the facilitating countries, the Catholic Church and the Special Adviser of the United Nations, and they agreed to define “the channels for more active international participation in support”.
AGREEMENT
Request the International Facilitation Commission, comprising Canada, Cuba, France, Italy, Mexico, Norway, Spain, Sweden, Switzerland and Venezuela to provide permanent support and good offices to the National Roundtable for Dialogue and Negotiation, with the commission represented by a rotating ambassador, who may be supported by other ambassadors that are members of the group.
Request the Secretary General of the United Nations, via his Special Adviser, to provide permanent support and good offices for the National Roundtable for Dialogue and Negotiation.
Request the Catholic Church of Colombia, represented by Monsignor Alberto Giraldo, President of the Episcopal Conference, or his representative, to provide permanent support and good offices to the National Roundtable for Dialogue and Negotiation.
In light of the above, the parties agree the following functions for the permanent support commission to the National Roundtable for Dialogue and Negotiation:
Attend the meetings of the National Roundtable for Dialogue and Negotiation.
Actively participate in the meetings of the National Roundtable for Dialogue and Negotiation upon request by the parties;
receive and study drafts of their proposals be present at the signing of agreements between the parties, receive information from the roundtable on developments in the process;
and offer and provide technical assistance as required by the parties.
It will also be entitled, when jointly requested, to issue recommendations to the parties to be studied and evaluated.
Provide good offices to help overcome obstacles that may arise in the context of the political negotiation process, in particular creating and maintaining an atmosphere favourable to the negotiations.
The parties may request bilateral meetings with the support commission or each of its members.
Explore support mechanisms involving the international community for the agreements reached by the roundtable, when requested by the parties in mutual agreement.
The discretion that must guide the course of the negotiations also extends to supporting parties for the process, who will only be allowed to make public declarations on the internal discussions of the roundtable with the express authorisation of both parties.
The supporting parties mentioned in this agreement do not form part of the National Roundtable for Dialogue and Negotiation and may only exercise their function of support and good offices in line with the previous conditions.
The Group of Friendly Countries and International Organisations (Agreement No.
27), the International Facilitation Commission (Agreement No.
28) and the Support Commission created in this agreement constitute the international support instruments for the National Roundtable for Dialogue and Negotiation.
